By signing up for an account with Nurika to use our Service on our website or software application (“the Sites”), you agree to be bound by these Terms of Service. Please, carefully read the Terms of Service below. If you do not agree with the terms, do not use our Services. Natural persons under 18 are not eligible to use our services.

Nurika offers a free lifestyle app that rewards users for engaging in healthy activities like walking, jogging, running, skipping, etc.

Nurika works with a movement validation algorithm with alternative activity-tracking smart devices and wearables that automatically synchronise with your smartphone and keep a record of your daily exercises while earning you NRK tokens.

1. Definitions

The following definitions relate to these Terms of Service:

  • "Account" is an electronic account stored with Nurika and created for use by the Customer to access Nurika’ Services;

  • "Content" means all information whether textual, visual, audio or otherwise, appearing on or available through the services;

  • Customer means an owner of a created account subscribing to or using one or more of Nurika’ Services;

  • “Fees” refers to charges applied to Customer accounts for use of, and access to Nurika’ Services.

  • "Services" refers to the Services provided to the customer by Nurika;

  • “Terms of Service” means these Terms of Service, the Privacy Policy, and all other policies posted on the Nurika Sites, as amended from time to time.

  • “NRK” refers to the Nurika token.

  • Manage your health;

  • Exclusive access to Nurika marketplace;

  • Receive access to the other range of Services available to you from or through Nurika;

4. Payment Method

Nurika accepts payment using an integrated link to a secured third-party payment platform that accepts credit cards, debit cards, and selected cryptos …. The Customer understands that it is solely responsible and liable for the information transmitted via the link and to any such persons it communicates the link to, and hereby releases Nurika from any liability in this regard.

5. Security and Unauthorised Use

You are responsible for all transactions conducted with Nurika via your registered account, using your computer, mobile phone, tablet or other electronic device. Your account sign-in details, passwords or other sensitive information must be kept safe. You are liable for all activities undertaken using your username, associated password or device. You are responsible for maintaining the confidentiality of all account information and keeping your account from unauthorized use.

We accept no liability for any unauthorized use of your account or any effects of same and you indemnify us against any claims made in respect of such use. In the event there is unauthorized access to your account, it is your responsibility to immediately notify us to restrict access to your account.

6. Customer Privacy

You accept that by using our Services, you will necessarily share confidential information with us. We undertake to protect and handle your private information as outlined in our Privacy Policy.

7. Suspension of Access to Platform

We hereby reserve the right to suspend, restrict, or terminate your access to our Services (in whole or in part) without any notice or liability in the following circumstances:

  • Upon receipt of instructions from you to suspend or terminate your access to the Services;

  • Upon receipt of notification from you of unauthorized access to your account;

  • If we suspect your account is being used for any illegal activities;

  • If we are of the opinion that you have breached any provision contained in this Terms of Service;

  • If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.

8. Unacceptable Use

You shall not and shall not permit any person using your account to conduct any fraudulent or illegal activities via our Services. You accept that if we have cause to believe that fraudulent activity is associated with the operation of your account, we have the right to apply restrictions to your account and report to the appropriate law enforcement authorities.

9. Indemnity

You agree to indemnify Nurika, its affiliates, officers, agents and employees for any loss, damages, liabilities, sanction, claims, suits, fines, charges, or expenses due to or arising out of any transaction you process through the platform.

10. Miscellaneous

  • You acknowledge and agree that you understand these Terms of Service written in English. You agree that these Terms of Service and all correspondence and all documentation relating to these Terms are first written in the English language. In the event of any conflict between the English version and a translated version, the English version shall prevail.

  • We reserve the right to terminate, change, suspend or discontinue any aspect of the Services at any time and without notice.

  • We reserve the right to amend these Terms of Service at any time and at our sole discretion. We shall give you notice of such amendment by publication of the amended version via the Sites. Your continued access to and use of the Service is your acceptance of and compliance with the updated Terms of Service. If you disagree with any part hereof, do not access our Services.

  • All copyright, trademarks and other intellectual property rights used as part of our Services or contained on the Sites belong to us or its licensors. Nothing set forth in these Terms of Service shall constitute a transfer, license or assignment by us to you of any Intellectual Property Rights owned by us or content displayed on the Sites.

  • If any provision of these Terms of Service is declared unlawful and/or unenforceable by operation of law, any court or authority, such provision be severed from these Terms of Service and rendered ineffective so far as is possible without modifying the remaining provisions of this Agreement.

  • You acknowledge and agree that these Terms of Service be interpreted and enforced in accordance with the laws of Mauritius without reference to conflict of laws principles.

  • The Parties shall use their best efforts to amicably settle all disputes arising out of or in connection with the performance or interpretation of these Terms of Service. Any dispute or differences arising out of the construction, interpretation or performance of the obligations created under this relationship which cannot be settled amicably shall be subject to the exclusive jurisdiction of the courts sitting in Nurika's host country.
